DECISION

The Court considers the instant motion equivalent to a general appearance. (See Air Machine Com SRL v. Superior Court (2010) 112 Cal.Rptr.3d 482 (the statutory acts constituting an appearance under CCP Section 1014 are not exclusive and the “term may apply to various acts which, under all the circumstances, are deemed to confer jurisdiction of the person.”).)

For this reason, the Court considers the motion withdrawn and takes the motion off calendar.
