DECISION
Good cause having been shown, the motion is granted, but not for the date requested.
The current trial and FSC dates are advanced and vacated.
Trial is set for November 1, 2023 at 8:30 a.m. in Department 30.
FSC is set for October 18, 2023 at 10:00 a.m. in Department 30.
Cutoff date for all fact discovery remains based on May 1, 2023 trial date, except for any depositions ordered as a result of the granting of any of the seven motions to compel compliance with deposition subpoena scheduled by Defendant between 5/12/23 and 7/19/2023.
Cutoff date for expert discovery is to be based on the new trial date.
Cutoff date for all motions remains based on the May 1, 2023 trial date except for the following the cutoff date for which is based on the new trial date: (1) any motions relating to failure to comply with a court order in the event the court grants any of the seven motions referenced above; (2) motions concerning expert discovery; and (3) motions in limine.
To the extent that the parties wish to participate in mediation, they are ordered to do so prior to the FSC.
The parties should not anticipate any further continuances. This is a firm trial date and the parties should be prepared to proceed.
Moving party is ordered to provide notice and to file proof of service of such notice within five court days after the date of this order.
