Motion to Continue Trial

DECISION

Good cause having been shown, the motion is granted.

Yesterday, Counsel for Defendant was instructed to move the scheduled MSJ hearing from April 17, 2023 to the first available date in the reservation system as the parties wanted a continuance of the date.

Instead, Counsel reserved a new hearing date for a motion for summary judgment on June 3, 2024.  Therefore, the parties will need to refile all motion papers with the new hearing date as they will not automatically move to the new hearing date.

The April 17, 2023 MSJ hearing is taken off calendar.

Briefing for the MSJ motion will be calculated as if the hearing date for the MSJ is August 1, 2023.  

The current trial and FSC dates are advanced and vacated.

Trial is set for July 8, 2024 at 8:30 a.m. in Department 30.

FSC is set for June 24, 2024 at 10:00 a.m. in Department 30.

Motion cutoff date, discovery cutoff date and all other dates are to comport with a trial date of July 3, 2023, except that cutoff dates for the following will be calculated based on the new trial date: (1) expert discovery; (2) motions regarding expert discovery; and (3) motions in limine. 

The Court further notes that it will hear the motion to compel reserved by Defendant for August 23, 2023 and that the cutoff date for any further discovery motions concerning the issue of VA medical records shall be calculated based on the new trial date. 

To the extent that the parties wish to participate in mediation, they are ordered to do so prior to the FSC.

The parties should not anticipate any further continuances. This is a firm trial date and the parties should be prepared to proceed. 

Moving party is ordered to provide notice and to file proof of service of such notice within five court days after the date of this order.
