Motion to Continue Trial

Good cause having been shown, the motion is granted in part.

The current trial and FSC dates are advanced and vacated.

Trial is set for March 30, 2023 at 8:30 a.m. in Department 30.

FSC is set for March 16, 2023 at 10:00 a.m. in Department 30.

All fact discovery and motions cutoff dates remain based upon the January 31, 2023 trial date, except for the second IME of Plaintiff. If that IME is not stipulated to by Plaintiff, Defendant is ordered to file a motion for leave to conduct an IME 

by January 17, 2023.  Defendant will then need to file an ex parte to advance the hearing on the motion/continue the trial date so that the motion may be heard.

All expert discovery and motion cutoff dates are to comport with the trial date of March 30, 2023. 

To the extent that the parties wish to participate in mediation, they are ordered to do so prior to the FSC.

Moving party is ordered to provide notice and to file proof of service of such notice within five court days after the date of this order.
