Plaintiff’s Motion to Compel Further Responses by Defendant Bustos to Form Interrogatories

DECISION

Plaintiff’s motion is granted with respect to Form Interrogatories Nos. 2.12, 2.13, 4.1, 12.1 20.1, 20.3, 20.4, 20.5, 20.6, 20.7, 20.8, 20.9, and 20.11

Defendant Bustos provides no support for his assertion of attorney-client privilege and attorney work product objections with respect to these interrogatories.

Defendant Bustos is ordered to serve verified responses without these objections within 20 days after the date of this order.

Plaintiff’s motion is denied with respect to Form Interrogatories Nos. 12.2, 12.3, 12.4, 12.5,  and 12.7

With respect to No. 12.4, information about sub rosa footage must be included if Plaintiff has already been deposed. If Plaintiff has been deposed, the motion is granted with respect to No. 12.4 in that respect only.

The Court declines to impose sanctions here as Defendant Bustos did provide substantive responses and indicates that those same responses will be provided again without objections. At the same time, the Court notes that the blanket privilege objections should not have been asserted. In the future, the Court will impose sanctions for failures to comply with the Code.
