Defendant’s Motion to Quash Subpoena of Plaintiff’s Medical Records

Decision:  Granted, in part with direction.  See below.

Court orders that the scope of the subpoena shall be limited to records from May 5, 2016 onward, and are limited to physical ailments, injuries, or symptoms that reflect upon injury to Plaintiff’s legs, including but not limited to complaints by Plaintiff of pain, discomfort, inability to perform duties, walk, or stand; Plaintiff’s request for accommodation due to any leg injury; and Plaintiff’s claims for worker compensation or monies for any leg injury.   Court finds that both sides had legitimate interests in pursuing the motion and filing the opposition. 

Request for sanctions is denied.

Moving party to give notice of the Court’s order within 5 court days of this order.
