Motion to Be Relieved as Counsel for Plaintiff.
DECISION
The motion is denied without prejudice.
Counsel failed to file the required MC-052. Counsel also failed to file a proof of service indicating that Plaintiff has been served with the papers.
As no proof of service or answer has been filed, the Court advances and vacates the FSC and trial dates, as well as the 8/14/2024 dismissal date.
The Court sets an OSC Re: Dismissal for Failure to Serve within Two Years of Filing of the Complaint/Failure to File POS for August 31, 2023 at 8:30 a.m.
The Court notes that new MC-051 and MC-053 will need to be filed and served as well.
Moving party is ordered to provide notice and to file proof of service of such notice within five court days after the date of this order.
