Motion for Leave to Conduct Neuropsychological Examination of Plaintiff filed by Defendants Maurice Nipp and Prima Die Company, Inc.

DECISION

The parties are ordered to appear at the hearing.

The Court wants to know if Plaintiff would be willing to add the following paragraphs to the stipulation located at Exhibit 1 to Plaintiff’s Opposition which then would become part of an order of the Court.

1. Plaintiff will not testify at trial about any neurological or psychological injuries allegedly caused by the accident (including but not limited to post-concussion syndrome, post traumatic headaches, posttraumatic dizziness/disequilibrium, tinnitus, traumatic brain injury, sleep difficulty, ringing in the ears, anxiety, loss of balance, slow processing speed, short term memory loss, difficulty processing, irritability, fogginess, depression, fatigue, sensitivity to light and noise, loss of smell, issues with speech, attention and concentration, head pain and pressure, difficulty hearing, and difficulty seeing.)

2. Plaintiff will only testify at trial about alleged injuries to his spine as a result of the accident.

3. No expert or any other witness at trial will testify about anything listed in paragraph one above.   

4. Plaintiff will not call Dr. Strickland, Dr. Aminian, and/or Dr. Avila at trial.
