DECISION
The motion is granted as Plaintiff is deceased.
Plaintiff passed away on December 30, 2021.
Thereafter, Plaintiff’s Counsel attempted to work with Plaintiff’s son, the sole heir, to proceed with the case as Plaintiff’s personal representative or successor in interest.
Plaintiff’s son has indicated that he does not wish to proceed with the representation and the son is not a client of the firm.
Since Plaintiff’s sole heir has not come forward to proceed in the matter as Plaintiff’s personal representative or successor in interest and has failed to comply with the requirement of CCP Section 377.31 and 377.32, the case is dismissed without prejudice.
