MOTION TO BE RELIEVED AS COUNSEL FOR DEFENDANT MY FAMILY HOSPICE & PALLIATIVE CARE

The motion is continued.
The parties are ordered to appear at the hearing to discuss a continued hearing date.
The Court has identified the following issues to be addressed: (1) on the MC-053, 5b should be marked, not 5a.and (2) the MC-053 does not contain any of the future court hearings. 
Defendant’s Counsel should come prepared to discuss at the hearing whether Defendant Family Hospice & Palliative Care is a corporation or other type of entity that is not permitted under the law to represent itself.
“[A] corporation, unlike a natural person, cannot represent itself before courts of record in propria persona, nor can it represent itself through a corporate officer, director or other employee who is not an attorney.” (CLD Construction, Inc. v. City of San Ramon (2004) 120 Cal.App.4th 1141, 1145; see also Merco Constr. Engineers, Inc. v. Municipal Court (1978) 21 Cal.3d 724, 727 (“the Legislature cannot constitutionally vest in a person not licensed to practice law the right to appear in a court of record in behalf of another person, including a corporate entity”).
Moving party to provide notice, including to Defendant Family Hospice & Palliative Care.

Proof of such notice must be filed within three days after the date of this order.
