DEFENDANT KOSTIV & ASSOCIATES, P.C.’S MOTION TO CONTINUE TRIAL DATE

Defendant's motion to continue the trial date and other dates is GRANTED in part and DENIED in part. 

Defendant has not established good cause for continuing discovery and motion cutoff dates. The parties have had ample time to complete discovery. 

The parties have not scheduled a mediation. Thoughts about a possible mediation do not provide the basis for a continuance of the trial date.

The Court will grant a continuance of the trial date to accommodate scheduling conflicts of defense witness Petro Kostiv, Defendant's CEO.

In order to encourage the parties to engage in private mediation, the Court will move deadlines with respect to expert discovery.

Any private mediation must be completed prior to the FSC date.

The trial date of March 18, 2024 and the Final Status Conference date of March 4, 2024 are advanced to today and continued as follows: trial is set for June 17, 2024 at 9:30 a.m. and the FSC is set for June 5, 2024 at 8:30 a.m. 

All discovery and motion cutoff dates are to be calculated based on the March 18, 2024 trial date except for the following the cutoff dates for which shall be based on the new trial date: (1) expert discovery; (2) motions regarding expert discovery; and (3) motions in limine.

Moving party to provide notice and to file proof of service of such notice within five court days after the date of this order.
