             Defendant moves for an order compelling Plaintiffs to provide further responses to its requests for the production of documents.

 

BACKGROUND

 

             This case arises out of Plaintiffs GGG Holdings LLC and Gevork Grigoryan (“Plaintiffs”) claim related to the sale of a 2023 Land Rover Range Rover Autobiography, Vehicle Identification Number SALK19E7XPA014162 (“Subject Vehicle”). Plaintiff filed this complaint on November 8, 2023.

 

TENTATIVE RULING

 

            Defendant’s motions to compel a response are DENIED as moot.

 

            Defendant’s requests for sanctions is granted for a total of $486.65.

 

LEGAL STANDARD

 

If a party to whom interrogatories are directed fails to serve a timely response, the party propounding the interrogatories may move for an order compelling a response to the interrogatories. (Code Civ. Proc. section 2030.290, subd. (b).) The same applies to a party that fails to respond to a request for document production. (Code Civ. Proc. section 2031.300, subd. (b).)

 

DISCUSSION

 

             Defendant moves for an order compelling each Plaintiff to provide further responses to its requests for the production of documents. Defendant provides it separately served its discovery requests on Plaintiffs on November 30, 2023. (Jenkins Decl. ¶ 3.) Defendant provides it attempted to meet and confer via email on January 5, 2024.  (Id. ¶ 4.) Plaintiffs provide that after the instant motions were filed, they served responses on February 1, 2024. (Margarian Decl. ¶ 8.) Thus, Defendant’s motions are denied as moot.

 

            Defendant’s requests for sanctions is granted for a total of $486.65, one hour worked at a rate of $425 plus the $61.65 filing fee. (Jenkins Decl. ¶ 6.)

 

CONCLUSION

 

            Defendant’s motions to compel a response are DENIED as moot.

 

            Defendant’s requests for sanctions is granted for a total of $486.65.
