CASE TITLE: CASE TYPE:

Civil - Unlimited  Business Tort Motion Hearing (Civil) 37-2013-00078078-CU-BT-CTL OVERLAND DIRECT INC VS. ESOLA CAPITAL INVESTMENT LLC [IMAGED] CAUSAL DOCUMENT/DATE FILED: Motion - Other, 07/17/2023

In response to the Motion (ROA # 2271) of Richardson Griswold, the court-appointed Receiver ('Receiver') for an order for further instructions regarding the next phase of receivership work, the Court takes no action in response to this request.

Instead, the Court sets an Order to Show Cause, Re: Why the Receivership of property located at 301 North Euclid Avenue, Ontario, California 91762 should not be dissolved with control of the property turned over to Plaintiffs.

This OSC hearing is set for September 15, 2023 at 9:00 a.m. in D 73.

Plaintiffs must file and serve papers supporting the proposed dissolution of the receivership by August 25, 2023.

Any response or opposition by the receiver or any other party must be filed and served by September 7, 2023.

Plaintiffs' reply brief must be filed by September 11, 2023. Email service will be permitted.

The recent jury verdict and forthcoming judgment will vest Plaintiffs with ownership and control of the property. As a result, it appears to make sense for control of the property to be turned over to Plaintiffs.

It appears there no longer exists any reason to incur receivership costs.
