The unopposed Motion (ROA # 123) of Plaintiffs David Stebbins and Tonya Haines ('Plaintiffs') to Compel and Request for Sanctions on Defendant VBH, INC. ('Defendant') only for their failure to respond to Plaintiffs' initial discovery including Form Interrogatories, Special Interrogatories, and Request for Production of Documents, will be HEARD.

Not clear to the Court is whether Defendant has served responses. If Defendant served responses, this Motion is DENIED in the absence of a separate statement by Plaintiffs to support this Motion. If Defendant did not serve responses, this Motion is GRANTED IN PART and DENIED IN PART as follows: Defendant is directed to serve Code-compliant responses, without objections, within twenty (20) days of the hearing of this Motion and produce the documents within twenty-five (25) days of the hearing of this Motion.

Defendant's failure to serve responses was without substantial justification. Attorney Willis' $325 hourly rate is reasonable. The services, as limited, were reasonable and necessary. Defendant is directed pay total sanctions, including costs, of $1,035.
