The Motion (ROA # 25) of Defendant Starside Security & Investigation, Inc. ('Defendant') for (1) a protective order and (2) an order for phased discovery (regarding interrogatories), (regarding document demands), 2033.080 (regarding requests for admissions) and (sequencing discovery) propounded by Plaintiff Dannie Sewell ('Plaintiff'), is DENIED.

Plaintiff's evidentiary objections (ROA # 31) are OVERRULED IN PART and SUSTAINED IN PART.

The objections are OVERRULED except as noted: nos. 1 and 2 are SUSTAINED.

The Court has read and considered Plaintiff's Complaint (ROA # 1) filed on July 7, 2022, and Defendant's Answer (ROA # 9) filed on August 29, 2022.

Defendant has now had twenty (20) months to investigate, issue document subpoenas and / or serve discovery to determine whether Plaintiff is a union member and whether Plaintiff's employment is encompassed within an arbitration agreement.

Defendant's moving brief states that a subpoena would be served on the union on March 15, 2024, and records would be due on March 30. However, the reply brief does not provide any status with respect to this subpoena.

Given these circumstances, there is no good cause justifying any further delay.
