The Motion (ROA # 11) of Plaintiff Louis Hughes III ('Plaintiff') for an order compelling the deposition of Defendant GENERAL MOTORS, LLC's Person or Persons Most Qualified, with production of documents, and for an order imposing monetary sanctions, is GRANTED IN PART and DENIED IN PART.
Plaintiff's evidentiary objections (ROA # 22) are OVERRULED IN PART and SUSTAINED IN PART.
The objections are OVERRULED except as noted: nos. 6 and 7 are SUSTAINED.
Defendant is directed, consistent with its counsel's representations, to produce a PMQ for a deposition within thirty (30) days of the hearing of this Motion. Defendant is further directed to produce the materials it represented it would produce in its responses to Plaintiff's requests within twenty-five (25) days of the hearing of this Motion. Defendant's objections are OVERRULED to the extent that it represented it would produce documents in its responses.
Plaintiff's request for sanctions is GRANTED. Defendant's failure to produce a PMQ for a deposition and produce the documents it agreed to do so before Plaintiff filed this Motion, was without substantial justification. Attorney Hunt's hourly rate is reasonable; however, the description of services is insufficiently specific to enable the Court to find whether the services were reasonable and necessary.
Accordingly, the Court awards total sanctions of $1,125 against Defendant only.
