The unopposed Motion (ROA # 32) of Plaintiffs Zachary Riggs and Angela Riggs ('Plaintiffs') for an order compelling Defendant Anita Cervantes ('Defendant') to respond to written discovery served by Plaintiff on March 19, 2024, deeming requests for admission granted, and for monetary sanctions, is GRANTED IN PART and DENIED IN PART.
In the absence of responses from Defendant, Plaintiffs' requests for admission are deemed admitted.
Defendant is directed to serve Code-compliant responses to Plaintiffs' form interrogatories, special interrogatories and production demands within twenty (20) days of the hearing of this Motion, and produce the documents within twenty-five (25) days of the hearing of this Motion.
Defendant's failure to serve responses was without substantial justification. Attorney Low's hourly rate is reasonable; however, the description of services is insufficient to enable the Court to find whether the services are reasonable and necessary. The Court imposes nominal sanctions, including the filing fee, of $160.
