Pursuant to Superior Court of San Diego County, Local Rules, rule 4.23.7, the Court's tentative ruling is as follows: The Motion to Stay Court Proceedings Pending Appeal (ROA 78) filed by Jeffrey Hitz, to which a non-opposition (ROA 96) has been filed, is GRANTED.

Proceedings in this matter are stayed pending resolution of the appeal and/or further order from this Court.

The Motion for Sanctions (ROA 42) filed by Deborah Rutter and Theodore Rutter is STAYED, and the moving party's right to have the motion heard after the conclusion of the appeal is reserved. The Court plans to set ROA 42 for a Case Management Conference for tracking purposes.

Jeffrey Hitz is ordered to serve written notice of ruling on all parties in accordance with the provisions of CCP § 1019.5(a).
