Defendants Katherman Kitts & Co., LLP and Stacie Kitts filed a Motion to Dismiss Action for Delay in Prosecution on May 2, 2022.  (ROA # 128, 130, and 152.)

On August 9, 2022, Plaintiff filed a Request for Dismissal of the entire operative Complaint without prejudice as to Defendants Katherman Kitts & Co., LLP and Stacie Kitts.  (ROA # 184.)  On August 11, 2022, Plaintiff filed a Notice of Entry of Dismissal and Proof of Service.  (ROA # 186.)

Accordingly, Defendants Katherman Kitts & Co., LLP and Stacie Kitts’ Motion to Dismiss Action for Delay in Prosecution is MOOT. 

The hearing is OFF CALENDAR.
