Motion to Strike or Tax Costs

Ruling:  Off Calendar – no hearing will be held.  Defendants’ Motion to Tax Costs directed to the Plaintiff’s memo of costs filed on 2-14-2022 is off calendar as MOOT. A memo of costs was filed on        8-5-2022.

It appears the Motion is MOOT as a subsequent Memo of Costs was filed on 8-5-2022 after this Motion was filed on 4-20-2022.

It also appears that by the parties’ own stipulation and order, the Motion is untimely.   See ROA 3-17-2022, which grants the time to bring the motion to 3-31-2022. This motion was not filed until 4-20-2022.
