Motion for Summary Judgment and/or SAI

Ruling:  Off Calendar – no hearing will be held.  Defendants Ronald Soderling, individually and as trustee of the Soderling Living Trust; Tod W. Ridgeway; and Ridgeway Development Company, Ltd.’s Motion for Summary Judgment is CONTINUED to 9-27-2022, Dept. C11, at 2 pm. Plaintiffs’ request for continuance pursuant to Code of Civil Procedure section 437c(h) to complete depositions of current and/or former employees of the City of Newport Beach is GRANTED.

The Court expects that the depositions will occur in accordance with the Court’s prior order dated July 20, 2022. (ROA 1538.) However, should they not, the Court will not be inclined to grant any further continuances without an explanation as to the efforts made to take the depositions, the reasons for any delay or inability to take the depositions, and the time by which it is anticipated that the depositions will be completed.

Given the continuance, the Court will decline to consider the merits of Plaintiffs’ opposing papers. Plaintiffs are to file and serve new opposing papers per Code. Any replies thereto are also per Code.
