Motion to Bifurcate

Ruling:  Off Calendar – no hearing will be held.  Defendant The Boeing Company seeks an order bifurcating the trial into two phases and precluding the presentation of evidence concerning Defendant’s financial condition, including but not limited to income and profits, until there has been a finding, if any, that Plaintiff is entitled to punitive or exemplary damages.

Defendant seeks the requested relief pursuant to Civil Code section 3295 and Code of Civil Procedure sections 598 and 1048, subd. (b).

Plaintiff filed a Notice of Non-Opposition. (ROA 280.)

As such, the unopposed motion is GRANTED pursuant to the above.
