Motion for Leave to File Amended Complaint

Ruling:  Off Calendar – no hearing will be held.  Plaintiff Rosilee Gamboa’s (“Plaintiff”) unopposed Motion for Leave to File a Second Amended Complaint is GRANTED.

Pursuant to Code of Civil Procedure section 473, the Court may allow a party to amend any pleading in furtherance of justice. (Code Civ. Proc., § 473, subd. (a).)  Plaintiff has complied with the requirements under California Rules of Court, rule 3.1324.  Defendant has not opposed the Motion and the Court finds that no prejudice will result from the granting of this Motion.

Plaintiff shall serve and file the proposed Second Amended Complaint within 10 days of this ruling.

Plaintiff is ordered to give notice.
