Motion to Be Relieved as Counsel of Record

 

Ruling:  Off Calendar – no hearing will be held.   Motion to Be Relieved as Counsel of Record is DENIED WITHOUT PREJUDICE.

 

Although Moving Attorney used and served (via email) the appropriate documents, there are some notable issues.

 

First, the name of withdrawing attorney is left blank on the Notice of Motion. (See Notice of Motion §1.)

 

Second, identification of supporting documents is left blank on the Notice of Motion. (See Notice of Motion §3.)

 

Third, Attorney failed to insert the date at signature line on the Notice of Motion.

 

Fourth, it is unclear whether the Law Corporation, individual attorney, or both seek to withdraw as attorney for record for Defendant Kang.  (See submitted documents generally.)

 

Fifth, although the Attorney Declaration states client was served by mail - which address was  “confirmed by email” -  the POS attached to each document indicates the papers were served via email.  So, it is unclear whether the documents were actually served on the client via mail.

 

Finally, the Proposed Order needs to be updated to reflect pending law and motion and CMC dates. As currently drafted the Proposed Order only reflects past dates.
