Ruling: Off Calendar – no hearing will be held. Defendant Danna Kang’s Motions to Quash are off calendar for failure to comply with this Court’s 2-8-2022 and 5-24-2022 orders. No sanctions.
Defendant Danna Kang filed five separate motions seeking to quash subpoenas served on various financial institutions. On 2-8-2022 this Court continued the five pending motions to quash subpoenas (ROAS 64, 68, 87, 95, 91) to 5-24 and ordered counsel to “meet and confer and file a joint separate statement as to remaining discovery disputes, 9 Court days prior to the continued hearing date.” Nine Court days before 5-24 would have been Wednesday 5-11; yet, no joint separate statement was filed.
Therefore, on 5-24-2022, this Court continued the motions to today’s date, 10-4-2022 and again ordered, “Counsel to meet and confer either in person, telephonically or via videoconference and in good faith. 9 Court days prior to the continued hearing date, counsel are to submit a joint separate statement as to the remaining discovery disputes. Should counsel fail to file the required joint separate statement, the Court will take these motions off calendar.” (Emphasis added.)
As of 9-26-2022 only RP Plaintiff’s counsel has filed any further documents herein. MP Defendant Danna Kang has not met and conferred or assisted in filing the Court ordered joint separate statement.
Therefore, the Motions are taken off calendar as a joint separate statement was not filed as required by the Court.
