Motion for Summary Judgment and/or SAI 

Ruling:  Off Calendar – no hearing will be held.   Defendant Shelly Automotive, LLC (“Defendant”) moves for summary judgment in its favor against Plaintiff James Marutsos’ (“Plaintiff”) Complaint. 

The Court has reviewed the parties’ Joint Stipulation filed on August 23, 2022.  Pursuant to the Stipulation, Plaintiff is allowed to file a first amended complaint and Defendants agree to withdraw all motions for summary judgment/adjudication filed on July 21-22, including the instant Motion.  The Court signed the Order on the Stipulation on August 25, 2022.  (See ROA 118.) 

Given the Joint Stipulation and Order, the instant Motion is taken OFF-CALENDAR. 

The following Motions are also taken OFF-CALENDAR: (1) Motion for Summary Judgment/Adjudication by Defendant Orange County British Motorcars, LLC dba Rolls-Royce Motorcars Orange County, set for hearing on October 25, 2022; (2)-(3) Motions for Summary Judgment/Adjudication by Defendants Frank Avena and Damon Shelly, set for hearing on November 1, 2022; (4) Motion for Summary Judgment/Adjudication by Defendant Roger See, set for hearing on November 15, 2022; and (5) Motion for Summary Judgment/Adjudication by Defendant Kellyn Dixon, set for hearing on November 22, 2022.
