Judge: John C. Gastelum, Case: 21-01214241, Date: 2023-11-01 Tentative Ruling

(1) Motion to Be Relieved as Counsel of Record (2) CMC

Ruling:  Off Calendar – no hearing will be held.  Motions to be relieved as counsel pursuant to Code of Civil Procedure section 284(2) are governed by California Rules of Court, Rule 3.1362.

All the requirements of California Rules of Court, Rule 3.1362 have been met, and the Declaration of Gabriel Sepulveda Sanchez, Esq. appears to demonstrate good cause for granting the motion based on “certain occurrences” that occurred during the course of representation, that have “given rise to the irremediable breakdown of the attorney-client relationship,” “such that SEPULVEDA SANCHEZ LAW, PC has determined they can no longer represent Plaintiff, SHARON MOORE.” (Declaration of Gabriel Sepulveda Sanchez, ¶ 2.) Although counsel does not describe these “certain occurrences,” it seems sufficient to state that there is an “irremediable breakdown of the attorney-client relationship,” and no prejudice appears.

Thus, the unopposed Motion to Be Relieved as Counsel filed by Gabriel Sepulveda Sanchez, Esq. as Counsel of Record for Plaintiff, Sharon Moore is GRANTED.

The order relieving counsel Gabriel Sepulveda Sanchez, Esq., as Counsel of Record for Plaintiff, Sharon Moore, is effective upon counsel filing proof of service of a copy of the signed order, and this Minute Order, on the client and on all parties that have appeared in the case. (California Rules of Court, Rule 3.1362(e).)

CMC is continued to 3-20-2023, Dept. C11, at 2 pm.

Counsel Gabriel Sepulveda Sanchez, Esq. to give notice.
