Motion for Summary Judgment and/or SAI

Ruling:  Off Calendar as MOOT – no hearing will be held.  Plaintiff Griffin Burke (“Plaintiff”) filed the instant Motion for Summary Adjudication on March 28, 2022, seeking adjudication of Defendant/Cross-Complainant Kamryn Whitney Court Reporting LLC’s (“Defendant”) claims for promissory fraud, punitive damages, open book account, and attorney’s fees set forth in Defendant’s Cross-Complaint. 

On September 27, 2022, Defendant dismissed its Cross-Complaint without prejudice.  (ROA 427.)  Plaintiff brought an ex parte application to vacate the dismissal filed by Defendant, which was denied on October 13, 2022.  (ROA 462.) 

Because Defendant’s Cross-Complaint has been dismissed, the Court takes Plaintiff’s Motion for Summary Adjudication OFF CALENDAR as MOOT.
