Demurrer to Complaint

Ruling: Off Calendar – no hearing will be held. Defendant BUILTEK CONSTRUCTION dk ENGINEERING and BENJAMIN DREW ABBOTT seeks an order sustaining its demurrer to the 1-8^th COAs of Plaintiff LAGUNA ELECTRIC, INC.’s Complaint.

Demurrer is continued to 11-15-2022, Dept. C11, at 2 pm due to procedural defects.

First, the demurrer was not served on all parties who have appeared in the action. Court orders MP to serve the demurrer on all parties who have appeared as of 9-8-2022.

Second, there is no meet and confer declaration as required by Code of Civil Procedure section 430.41. Counsel to submit a code compliant meet and confer declaration nine (9) Court days prior to the continued hearing date.

Defendant to give notice of the Court’s ruling.
