motion to be relieved as counsel

 

 

Plaintiff’s counsel, Arta K. Wildeboer (“Counsel”), moves to be relieved as counsel for Plaintiff Rodolfo Estrada (“Plaintiff/Defendant”). 

Counsel filed this instant motion to be relieved as counsel on November 21, 2022.  Counsel has filed the requisite forms pursuant to CRC Rule 3.1362. 

On December 2, 2022, Plaintiff filed a Notice of Withdrawal of Ryan A Ellis, Esq. of the Ryan Ellis Law Corporation as counsel for Plaintiff.  The notice states that the Law Office of Arta Wildeboer will remain as counsel for Plaintiff in this action. 

According to the declaration of Counsel Wildeboer, Counsel seeks to be relieved as counsel because there has been an irreconcilable breakdown in the attorney-client relationship, making continued representation impossible.  (MC-052, §2.)  For these reasons, Counsel seeks to withdraw from representing Plaintiff in this action. 

Counsel properly served Plaintiff at his last known mailing address, which was confirmed by telephone within the past 30 days of filing the motion.  Defense counsel was also served with the motion by mail and email.

As for future hearing dates, the Final Status Conference is set for July 13, 2023 and the Trial is set for July 24, 2023.  Thus, there is sufficient time for Plaintiff to obtain substitute counsel.

Accordingly, the motion to be relieved as counsel is granted.  Counsel is ordered to electronically lodge a copy of the proposed order Form MC-053 for the Court’s signing.  Currently, the Form MC-053 proposed order is attached to the Form MC-051 and Form MC-052 in a single filing. The order should be separately lodged.  The order will become effective upon the filing of a proof of service of a signed copy of the order on Plaintiff.
