motion for order that matters be deemed admitted

 

 

On July 7, 2022, Plaintiff Creditors Adjustment Bureau, Inc. (“Plaintiff”) filed a motion for order deeming Requests for Admissions (“RFA”), set one, admitted against Defendant Resmac, Inc. (“Defendant”).

On May 20, 2022, Plaintiff served on Defendant the RFA requests.  Plaintiff states that it sent an email to defense counsel seeking responses but received no communication back.  As of the filing of this motion, Plaintiff states that it has not received responses from Defendant. 

Plaintiff’s unopposed motion for an order deeming the RFAs admitted is granted, pursuant to CCP § 2033.280. 

Plaintiff requests sanctions against Defendant and its attorney in the amount of $1,461.65 (=$500/hour x [1.8 hours on this motion + 1 hour for the hearing], plus $61.65 in filing fees).  The request is granted in the reasonable sum of $561.65.  Defendant and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $561.65 to Plaintiff, by and through counsel, within 20 days of notice of this order.
