motion to compel responses

 

 

On July 20, 2022, Plaintiff Creditors Adjustment Bureau, Inc. (“Plaintiff”) filed a motion to compel Defendant Resmac, Inc. (“Defendant”) to provide responses to Form Interrogatories, set one (“FROG”).

On May 20, 2022, Plaintiff served on Defendant the FROG requests.  Plaintiff states that it sent correspondence to defense counsel seeking responses but received no communication back.  As of the filing of this motion, Plaintiff states that it has not received responses from Defendant. 

Plaintiff’s unopposed motion to compel responses to the FROG is granted pursuant to CCP § 2030.290.  Defendant is ordered to provide verified responses to Plaintiff’s discovery requests, without objections, within 20 days of notice of this order. 

Plaintiff requests sanctions against Defendant and its attorney in the amount of $2,061.65 (=$500/hour x [4 hours on this motion], plus $61.65 in filing fees).  The request is granted in the reasonable sum of $561.65.  Defendant and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $561.65 to Plaintiff, by and through counsel, within 20 days of notice of this order.
