 [TENTATIVE] order RE:

motion to compel responses; request for sanctions

 

 

On December 21, 2022, Cross-Complainant Noraeir Hovsepian, an individual dba Gaveet Construction (“Gaveet”) filed a single motion to compel initial responses from Cross-Defendant Vanik Manooki, individually and dba Narvan Construction Co. (“Narvan”) for: (1) Form Interrogatories (“FROG”), set one; and (2) Request for Production of Documents (“RPD”), set one.  Gaveet also seeks an order compelling Navran to provide initial responses or for an order deeming Requests for Admissions (“RFA”), set one, admitted. 

On February 14, 2022 and again on August 23, 2022, Gaveet served on Narvan the discovery requests.  On October 25, 2022, Gaveet inquired about the responses and advised Narvan’s counsel that all objections would be waived and RFAs admitted if responses were not provided.  Gaveet argues that its counsel made multiple attempts to request responses to discovery.  As of the filing of the motions, Gaveet states that it has not received responses from Narvan. 

Gaveet’s unopposed motion to compel responses to the FROG and RPD is granted pursuant to CCP §§ 2030.290 and 2031.300.  Narvan is ordered to provide verified responses to the discovery requests, without objections, within 20 days of notice of this order. 

Gaveet’s unopposed motion for an order deeming the RFAs admitted is granted, pursuant to CCP § 2033.280. 

Gaveet requests sanctions against Narvan and his attorney in the amount of $1,411.65 (= $450/hour x [2 hours to prepare motion + 1 anticipated hour for reply and court appearance], plus $61.65 filing fee).  The request is granted in the amount of $961.65, as the motion was not opposed.  Narvan and his counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $951.65 to Gaveet, by and through counsel, within 20 days of notice of this order.
