On August 23, 2022, Defendant American Honda Motor Co., Inc. (“AHM”) filed 2 motions to compel initial responses from Plaintiff The City of Los Angeles, acting by and through the Los Angeles Department of Water and Power (“LADWP”) for: (1) Special Interrogatories (“SROG”), set one; and (2) Request for Production of Documents (“RPD”), set one. On October 27, 2022, AHM filed 2 amended notices of motions to compel LADWP’s responses to the SROG and RPD. On January 11, 2023, AHM filed notices of non-opposition to its motions, stating it was not in receipt of opposition briefs from LADWP.
On August 22, 2022, AHM served on LADWP the discovery requests. AHM argues that LADWP’s responses were due by May 25, 2022, but LADWP did not serve responses and did not request an extension. The parties met and conferred and LADWP agreed to provide responses by July 7, 2022, but AHM did not receive responses. As of the filing of the motions, AHM states that it has not received responses from LADWP.
AHM’s unopposed motions to compel responses to the SROG and RPD are granted pursuant to CCP §§ 2030.290 and 2031.300. LADWP is ordered to provide verified responses to AHM’s discovery requests, without objections, within 20 days of notice of this order.
No sanctions were requested.
The Case Management Conference set on March 8, 2023 is continued to April 5, 2023.
Defendant American Honda Motor Co., Inc. shall provide notice of this order.
