order RE: motions to compel discovery responses; requests for sanctions |
On October 3,
2023, Defendants Aiten Levy and Ingeborg Levy (“Defendants”) filed 3 motions to
compel initial responses from Plaintiff 6824 Ben Avenue, LLC (“Plaintiff”) for:
(1) Form Interrogatories (“FROG”), set one; (2) Special Interrogatories
(“SROG”), set one; and (3) Request for Production of Documents (“RPD”), set
one. Defendants also filed a motion for
order deeming Requests for Admissions (“RFA”), set one, admitted.
On September 25,
2023, Defendants served on Plaintiff the discovery requests, such that responses
were due by October 2, 2023 in this unlawful detainer action. As of the filing of the motions, Defendants
state that they have not received responses from Plaintiff.
Defendants’ unopposed motions
to compel responses to the FROG, SROG, and RPD are granted pursuant to CCP §§ 2030.290
and 2031.300. Plaintiff is ordered to
provide verified responses to Defendants’ discovery
requests, without
objections, within 20 days of notice of this order.
Defendants’ unopposed motion
for an order deeming the RFAs admitted is granted, pursuant to CCP § 2033.280.
Defendants request
sanctions against Plaintiff and its attorney in the amount of $455 per motion
(= $395 to prepare each of the 4 motions, plus $60 in filing fees per motion). The requests are granted. Plaintiff and its counsel
of record, jointly and severally, are ordered to pay monetary sanctions in the
amount of $1,820 to Defendants, by
and through counsel, within 20 days of notice of this order.
Defendants shall provide
notice of this order.
