motion to be relieved as counsel

 

 

Defense counsel, Tiffany N. Travilion (“Counsel”), moves to be relieved as counsel for Defendant Desiree Camille Young (“Defendant”). 

Counsel filed this instant motion to be relieved as counsel on July 13, 2023.  Counsel has filed the requisite forms pursuant to CRC Rule 3.1362. 

According to the declaration of Counsel, Counsel seeks to be relieved as counsel because she agreed to represent Defendant on a limited scope basis pursuant to a Notice of Limited Scop Representation (filed April 19, 2023) and she has completed her scope of representation, but Defendant has refused to return a signed Substitution of Attorney form, which is a breach of the attorney-client agreement.  (MC-052, §2.)  For these reasons, Counsel seeks to withdraw from representing Defendant in this action. 

Counsel properly served Defendant at her last known address, which was confirmed by email within the past 30 days of filing the motion.  Plaintiff’s counsel was also served with the motion by e-mail.

As for future hearing dates, a Mandatory Settlement Conference is set for March 8, 2024, the Final Status Conference is set for June 13, 2024, and the Trial is set for June 24, 2024.  Thus, there is sufficient time for Defendant to obtain substitute counsel.

Accordingly, the motion to be relieved as counsel is granted.  The order electronically lodged by Counsel will be signed at the hearing.  The order will become effective upon the filing of a proof of service of a signed copy of the order on Defendant.
