On February 14,
2023, Petitioner American States Preferred Insurance Company (“Petitioner”)
filed 3 motions to compel initial responses from Respondent Pamela Moeck (“Respondent”)
for: (1) Form Interrogatories (“FROG”), set one; (2) Special Interrogatories
(“SROG”), set one; and (3) Request for Production of Documents (“RPD”), set
one.
On November 7,
2022, Petitioner served on Respondent the discovery requests, such that
responses were due by December 9, 2022. Petitioner
states that Respondent never requested an extension. On December 13, 2022, Petitioner sent a
letter to Respondent’s counsel requesting responses within 10 days. As of the filing of the motions, Petitioner states
that it has not received responses from Respondent.
Petitioner’s unopposed motions
to compel responses to the FROG, SROG, and RPD are granted pursuant to CCP §§ 2030.290
and 2031.300. Respondent is ordered to
provide verified responses to Petitioner’s discovery requests, without
objections, within 20 days of notice of this order.
Petitioner shall provide
notice of this order.
