 [TENTATIVE] order RE:

motions to compel discovery responses; requests for sanctions

 

 

There are 4 motions on calendar.

On October 6, 2023, Plaintiff Maggie Young (“Plaintiff”) filed a motion to compel initial responses from Defendant Alpaca Apartments, LLC (“Alpaca”) for Form Interrogatories (“FROG”), set one and Special Interrogatories (“SROG”), set one.  On October 9, 2023, Plaintiff filed a motion for order deeming Requests for Admissions (“RFA”), set one, admitted against Alpaca.

On October 9, 2023, Plaintiff filed a motion to compel initial responses from Defendant ADR/Preferred Business Properties (“ADR”) for FROG and SROG.  Plaintiff also filed a motion for order deeming Requests for Admissions (“RFA”), set one, admitted against ADR.   

  On October 24, 2023, Plaintiff filed a notice of non-opposition to the motions, stating that she was not in receipt of opposition briefs. 

On June 6, 2023, Plaintiff served on Defendants the discovery requests.  Defendants requested and Plaintiff granted an extension such that responses were due by August 22, 2023. Plaintiff did not receive responses by August 22, 2023 and granted another extension until September 18, 2023.  As of the filing of the motions, Plaintiff states that she has not received responses from Defendants. 

Plaintiff’s unopposed motions to compel responses to the FROG and SROG from Defendants Alpaca and ADR are granted pursuant to CCP § 2030.290.  Defendants are ordered to provide verified responses to Plaintiff’s discovery requests, without objections, within 20 days of notice of this order. 

Plaintiff’s unopposed motions for an order deeming the RFAs admitted against Defendants Alpaca and ADR are granted, pursuant to CCP § 2033.280. 

In connection with the motions filed against Alpaca, Plaintiff seeks $187.50 for the FROG/SROG motion (=$375/hour x 0.5 hour) and $1,237.50 for the RFA motion (=$375/hour x [1.3 hours on the motion + 2 anticipated hours for the reply brief and the hearing]).  The requests are granted.  Defendant Alpaca and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $1,425 to Plaintiff, by and through counsel, within 20 days of notice of this order.

In connection with the motions filed against ADR, Plaintiff seeks $1,950 for the FROG/SROG motion (=$375/hour x [3.2 hours on the motion + 2 anticipated hours for the reply brief and the hearing]) and $187.50 for the RFA motion (=$375/hour x 0.5 hour).  The requests are granted.  Defendant Alpaca and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $2,137.50 to Plaintiff, by and through counsel, within 20 days of notice of this order.

Plaintiff shall provide notice of this order.
