 [TENTATIVE] order RE:

motions to compel discovery responses; requests for sanctions

 

 

On October 8, 2024, Defendants Eduard Barakyozyan and Adrine Isayan (“Defendants”) filed 3 motions to compel initial responses from Plaintiff Albert Valle (“Plaintiff”) for: (1) Form Interrogatories (“FROG”), set one; (2) Special Interrogatories (“SROG”), set one; and (3) Request for Production of Documents (“RPD”), set one.  

On June 14, 2024, Defendants served on Plaintiff the discovery requests.  Defendants state that their counsel contacted Plaintiffs’ counsel to informally resolve the discovery matter.  However, as of the filing of the motions, Defendants state that they have not received responses from Plaintiff. 

Defendants’ unopposed motions to compel responses to the FROG, SROG, and RPD are granted pursuant to CCP §§ 2030.290 and 2031.300.  Plaintiff is ordered to provide verified responses to Defendants’ discovery requests, without objections, within 20 days of notice of this order. 

Defendants request sanctions against Plaintiff and his attorney in the amount of $901.65 per motion (= 2.5 hours spent on the moving papers + 2 anticipated hours on the reply and the hearings, at $240/hour, plus $61.75 in filing fees).  The requests are granted in the amount of $720 in attorney’s fees and $185.25 in filing fees.  Plaintiff and his counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $905.25 total to Defendants by and through counsel, within 20 days of notice of this order.

Defendants shall provide notice of this order.
