 [TENTATIVE] order RE:

motions to compel responses; requests for sanctions

 

 

On February 11, 2025, Defendant Alfred Khoadverdy (“Defendant”) filed 2 motions to compel initial responses from Plaintiff Ali Hajimirsadeghi (“Plaintiff”) for: (1) Special Interrogatories (“SROG”), set two; and (2) Demand for Identification and Inspection of Documents (“DIID”), set two.  

On November 13, 2024, Defendant served on Plaintiff the discovery requests, such that discovery responses were due by December 15, 2024.  No extensions were requested.  On January 7, 2025, defense counsel sent a meet and confer letter to Plaintiff’s counsel, asking for responses within 10 days.  As of the filing of the motion, Defendant states that he has not received responses from Plaintiff. 

On March 28, 2025, Plaintiff filed an opposition brief, stating that responses were served as to the SROG and DIID on March 28, 2025 by e-mail.  (Guevara Decl., ¶¶2-3, Exs. 1-2.) 

Defendant’s motions to compel responses to the SROG and DIID are denied as moot in light of the responses that were provided. 

Thus, the only remaining issue is sanctions. 

Defendant requests sanctions against Plaintiff in the amount of $586.65 per motion (=3 hours on the motion x $175/hour + $61.65 filing fee).  The requests are granted in the reasonable amount of $823.30 (= 4 hours total x $175/hour, plus $123.30 in filing fees), as these are relatively simple motions to compel initial responses and the motions prompted Plaintiff to respond to the discovery requests.  Plaintiff is ordered to pay monetary sanctions in the amount of $823.30 to Defendant, by and through counsel, within 20 days of notice of this order.

Defendant shall provide notice of this order.
