On April 4, 2024,
ARF
Financial LLC f/k/a Advance Restaurant Finance, LLC, a California limited
liability company, assignee of Mission Valley Bank (“Plaintiff”) filed a motion
for order deeming Requests for Admissions (Truths of
Facts) and Requests for Admissions (Genuineness of Documents) (collectively, “RFA”),
set one, admitted against Defendant Michael Don Donoho (“Defendant”).
The Court is not
in receipt of an opposition brief. The
Court notes that on February 2, 2024, Defendant’s then-counsel was relieved as
counsel.
On October 5,
2023, Plaintiff
served on Defendant the RFA requests, such that responses were due by November
9, 2023. Plaintiff states that it served
a meet and confer letter on Defendant on November 14, 2023, which provided an
extension of time to respond, but no responses were received. As of the filing of the motions, Plaintiff
states that it has not received responses from Defendant.
Plaintiff’s unopposed motion
for an order deeming the RFAs admitted is granted, pursuant to CCP §
2033.280.
No sanctions
were requested.
Plaintiff shall provide
notice of this order.
