 [TENTATIVE] ORDER RE:

MOTIONS TO COMPEL DISCOVERY RESPONSES; REQUESTS FOR SANCTIONS

 

 

On August 9, 2024, Defendant Andrew Renner, M.D. (“Defendant”) filed 2 motions to compel initial responses from Plaintiff Michael Patrick Loftus (“Plaintiff”) for: (1) Form Interrogatories, set one (“FROG”) and Special Interrogatories, set one (“SROG”); and (2) Request for Production of Documents, set one (“RPD”).  On August 12, 2024, Defendant filed notices of errata with updated declarations of defense counsel Taryn A. Perez in support of the motions. 

On May 15, 2024, Defendant served on Plaintiff the discovery requests, such that responses were initially due by June 17, 2024.  Plaintiff requested and Defendant granted extensions such that responses were due by July 26, 2024.  As of the filing of the motions, Defendant states that he has not received responses from Plaintiff. 

Defendant’s unopposed motions to compel responses to the FROG, SROG, and RPD are granted pursuant to CCP §§ 2030.290 and 2031.300.  Plaintiff is ordered to provide verified responses to Defendant’s discovery requests, without objections, within 20 days of notice of this order. 

Defendant requests sanctions against Plaintiff in the amount of $1,980 for each motion.  The requests are granted in the total reasonable sum of $600 in attorney’s fees and $120 in filing fees for these relatively simple and identical motions to compel.  Plaintiff is ordered to pay monetary sanctions in the amount of $720 to Defendant, by and through counsel, within 20 days of notice of this order.

Defendant shall provide notice of this order.
