motions to compel discovery responses; requests for sanctions

 

 

There are 4 discovery motions on calendar. 

On October 3, 2024, Plaintiff Brenda Gordon (“Plaintiff”) filed 2 motions to compel initial responses from Defendant I Guard Services, Inc. (“I Guard”) for: (1) Form Interrogatories – General, set one (“FROG-General”) and Form Interrogatories – Employment, set one (“FROG-Employment”); and (2) Request for Production of Documents (“RPD”), set one.  Plaintiff also filed 2 motions to compel initial responses from Defendant United Protective Services, Inc. (“UPS”) for: (1) FROG-General and FROG-Employment; and (2) RPD. 

On July 22, 2024, Plaintiff served on Defendants the discovery requests.  Plaintiff states that her counsel contacted defense counsel for the responses, but did not hear back and no extensions were requested.  As of the filing of the motions, Plaintiff states that she has not received responses from I Guard and UPS. 

Plaintiff’s unopposed motions to compel I Guard’s and UPS’s responses to the FROG-General, FROG-Employment, and RPD are granted pursuant to CCP §§ 2030.290 and 2031.300.  Defendants I Guard and UPS are each ordered to provide verified responses to Plaintiff’s discovery requests, without objections, within 20 days of notice of this order. 

Plaintiff requests sanctions against I Guard and its attorney in the amount of $2,250 for each of the 2 motions filed against it (= 2 hours for the motion + 3 anticipated hours for a reply brief and to attend the hearing at $450/hour, per motion).  Plaintiff also requests sanctions against UPS and its attorney of record in the amount of $2,250 for each of the 2 motions filed against it.  The requests are granted in the reasonable amount of $200 per motion. 

Defendant I Guard and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $400 to Plaintiff, by and through counsel, within 20 days of notice of this order.  Defendant UPS and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $400 to Plaintiff, by and through counsel, within 20 days of notice of this order.

Plaintiff shall provide notice of this order.
