order RE: motion to be relieved as counsel |
Plaintiff’s counsel, J. Owen Murrin
(“Counsel”), moves to be relieved as counsel for Plaintiff Roobik Thorossian
(“Plaintiff”).
Counsel filed this instant motion to be
relieved as counsel on March 27, 2025. Counsel has filed the requisite forms pursuant
to CRC Rule 3.1362. However, the MC-053
proposed order form was rejected by the clerk of the court for failure to
properly fill out all sections.
According to the declaration of Counsel,
Counsel seeks to be relieved as counsel because there has been an irretrievable
breakdown of the attorney-client relationship where Plaintiff refuses to talk
with Counsel over the phone and Plaintiff has been accusatory towards Counsel. (MC-052, §2.) For these reasons, Counsel seeks to withdraw
from representing Plaintiff in this action.
Counsel properly served Plaintiff at his
last known mailing address, which was confirmed by telephone within the past 30
days of filing the motion.
As for future hearing dates, a demurrer is
set for April 25, 2025. The case
management conference is set for May 13, 2025.
As such, a trial date has not yet been set. Thus, there is sufficient time for Plaintiff
to obtain substitute counsel.
Accordingly, the motion to be relieved as
counsel is granted. Counsel is ordered
to electronically lodge a corrected MC-053 proposed order form for the Court’s
signing. Upon submission of the form,
the Court will sign the order. The order
will become effective upon the filing of a proof of service of a signed copy of
the order on Plaintiff.
