motions to compel discovery responses; requests for sanctions

 

 

On November 7, 2024, Defendant Stephanie Bressler (“Defendant”) filed six (6) total discovery motions to compel initial responses from Plaintiffs Graciela Ramirez and Maria Dej Hidalgo Herrerra (“Plaintiffs”).  Defendant filed two versions of each of the following motions, one addressed to each Plaintiff for: (1) Form Interrogatories, (2) Special Interrogatories, and (3) Demand for Inspection and Production of Documents.  

On July 3, 2024, Defendant served Plaintiff the discovery requests.  On September 13, 2024, Defendant contacted Plaintiff’s counsel about the lack of responses and requested responses by September 20, 2024.  As of the filing of the motions, Defendant states that she has not received responses from Plaintiff. 

Defendant’s unopposed motions to compel responses to the Form and Special Interrogatories and Document Demand are granted pursuant to CCP §§ 2030.290 and 2031.300.  Plaintiffs are ordered to provide verified responses to Defendant’s discovery requests, without objections, within 20 days of notice of this order. 

Defendant requests sanctions against Plaintiffs and their attorney in the amount of $455.34 for each of the Documents Demand motion and $455.34 each on the Form/Special Interrogatories motions, for a grand total of $2,732.04.  The requests are granted but in the reasonable amount of $1,000 total on these relatively simple motions to compel initial responses.  Plaintiffs and their counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $1,000 to Defendant, by and through counsel, within 20 days of notice of this order.

Defendant shall provide notice of this order.
