 [TENTATIVE] order RE:

motion to compel and for sanctions

 

On September 19, 2023, Defendant Crispin Luna (“Defendant”) filed a motion to compel initial responses from Plaintiff Navy Federal Credit Union (“Plaintiff”) for: (1) Special Interrogatories (“SROG”), set one; and (2) Inspection Demands, set one. 

On July 14, 2023, Defendant served on Plaintiff the discovery requests.  Defendant states that her counsel sent a letter to Plaintiff’s counsel asking for responses by August 7, 2023 and for Plaintiff’s counsel to contact defense counsel if responses could not be timely provided.  On September 5, 2023, Plaintiff’s counsel contacted defense counsel stating that response would be provided by the end of the week.  As of the filing of the motions, Defendant states that she has not received responses from Plaintiff.  

Defendant’s unopposed motion to compel responses to the SROG and Inspection Demands are granted pursuant to CCP §§ 2030.290 and 2031.300.  Plaintiff is ordered to provide verified responses to Defendant’s discovery requests, without objections, within 20 days of notice of this order. 

Defendant requests sanctions against Plaintiff and its attorney in the amount of $861.63 (= 2.5 hours spent on the motion and 1.5 anticipated hours attending the hearing at $200/hour, plus $61.63 filing fee).  The request is granted in the amount of $561.63.  Plaintiff and its counsel of record, jointly and severally, are ordered to pay monetary sanctions in the amount of $561.63 to Defendant, by and through counsel, within 20 days of notice of this order.

Defendant shall provide notice of this order.
