Plaintiff’s motion to have her RFAs deemed admitted is GRANTED. Defendant is sanctioned $700.00.           

 

On 3/27/2019, Plaintiff Estela Vargas (Plaintiff) filed suit against Ruth Chang (Defendant) seeking damages, partition, accounting, and equitable relief.

 

            Now, Plaintiff moves to deem her requests for admission (RFAs) admitted.

 

            The motion is unopposed.

 

Discussion

 

            On 12/1/2020, Plaintiff served RFAs on Defendant. As such, responses were due on 1/4/2020. No responses have been received to date.

 

            Based on the foregoing, Plaintiff’s motion to have her RFAs deemed admitted is granted. 

 

Defendant did not oppose this motion, and has not set forth substantial justification for this failure. As a result, Defendant, who is self-represented, is sanctioned $700.00. ($350/hr x 2 hr.)

 

It is so ordered.
