After
review, the Court has identified the following deficiencies:

Plaintiff has not adequately explained
how the $347,370.00 in damages was calculated.

Plaintiff has not submitted evidence,
or alleged facts, which could justify piercing the corporate veil to impose
individual liability on Deparseghian. As alleged, Plaintiff indicated that
Plaintiff entered into an oral agreement with Star DP Design House, with
Deparseghian acting on behalf of Star DP. Plaintiff must submit case law and
facts in the summary of the case to show that individual liability may be
imposed on Deparseghian, and that she was a party to the contract in her
individual capacity.

Plaintiff claims to have paid
$193,654.70 pursuant to the agreement, and submitted four wire transfers to
show this. However, the four wire transfers show a total of only $126,425.85.

Plaintiff claims to have spent sums of
$65,790.00 and $50,000, but does not submit any extrinsic evidence to support
the $50,000 claim. While the $65,790.00 sum was included in the Complaint, the
$50,000 payment was not. The demand letter submitted as Exhibit B also makes no
mention of the $50,000.
