DEPARTMENT 17

TENTATIVE RULING

MARTHA DEL CAMPO

         vs.

ALLIED WORLD ASSURANCE COMPANY (U.S.) INC., et al.

 Case No.:  21STCV12443

 Hearing Date: March 3,  2023

Plaintiff’s motion to compel site inspection is MOOT.

On 12/16/2021, Martha Del Campo (Plaintiff) filed suit against VSV Mutual Group, Inc (VSV) and Sevan Toroussian, alleging: (1) whistleblower violations; (2) unsafe workplace violations; (3) failure to provide meal and rest periods; (4) failure to pay wages in violation of California Labor Code section 201; (5)  failure to furnish compliant wage statements and maintain accurate pay records; (6) waiting time penalties; (7) unfair business practices; (8) retaliation and wrongful termination of public policy.

On 11/7/2022, the Court continued this motion, and directed the parties to file supplemental briefing per code if the motion was still required. The Court also directed the moving party to vacate the hearing and file a Notice of Withdrawal if the motion was no longer needed.

No supplemental briefing was submitted, leading the Court to believe that the issue has resolved, and this matter is now moot. However, given that the hearing was not vacated and no Notice of Withdrawal was filed, the Court is unable to know for certain.
