After review of Plaintiff’s default judgment packet, the Court has identified the following deficiencies:

 

-         - CRC rule 3.207 provides that attorney fees awarded on default must be determined in accordance with Local Rule 3.214.

 

-         Plaintiff must establish personal liability against Matthew Wilkie. The escrow loan documents list Cal Developers, Inc. as the borrower, and Plaintiff did not identify a provision in which Wilkie signed as a personal guarantor. While Plaintiff alleges alter-ego liability in the Complaint, Plaintiff did not submit any evidence which could support this, and his allegations are alleged on information and belief alone. Plaintiff must either submit supporting evidence, or submit a legal brief setting forth legal authority which shows that Plaintiff’s allegations on information and belief, alone, are sufficient to establish alter-ego liability in a default judgment.
